Terms of Service

1. Services

byori.us provides web design, domain management, AI chat setup, hosting management, and logo creation services for beauty professionals. Services included in your order are determined by your selected package and add-ons.

2. Payment Terms

All website packages require a 50% non-refundable deposit to begin work. The remaining 50% is due upon delivery and approval.

• The deposit covers intake, planning, design preparation, and opportunity cost.
• Work does not begin until the deposit is confirmed.
• The balance is due before the site goes live. byori.us may withhold launch until the balance is paid in full.
• Logo Add-On: $49 paid in full upfront, non-refundable once design process begins.
• AI Add-On: Full annual fee paid upfront, non-refundable after activation. Auto-renews annually.
• Monthly AI: Billed monthly, cancels at end of billing period.

3. Logo Add-On Policy

The logo add-on is $49 paid in full upfront. Upon payment, byori.us generates logo concepts using AI design tools based on your brief.

• You will receive exactly 3 curated logo concepts. No additional concepts, variations, or revisions are included.
• You select one concept as your final logo, delivered as PNG and SVG.
• A new order at the current price is required for additional concept sets.
• This policy is non-negotiable and acknowledged in your service agreement.

4. Asset Delivery Deadline

You are responsible for providing all content (photos, business name, services, pricing, booking link, bio, etc.) within 30 days of your deposit payment. Failure to deliver assets within 30 days forfeits the deposit with no refund. A 14-day grace period may be granted upon written request.

5. Revision Policy

Each package includes one (1) free change within 7 days of site launch.

• A "change" is defined as: a single content update (text, photo, price) or minor style tweak (button color, font size).
• Not covered: layout redesigns, new sections, new overall aesthetic direction, or multiple simultaneous changes.
• Style direction is previewed and approved during onboarding. Aesthetic redesigns are a new project.
• After the free change is used, or after 7 days: $30 per update or $75/month retainer for unlimited minor updates.

6. Domain Ownership & Hosting

• Basic tier: Site hosted on yourname.byori.us. byori.us owns and controls this subdomain.
• Starter tier: You purchase and own your domain. byori.us configures DNS as a service.
• Pro tier: byori.us purchases a domain in your name. You retain full ownership. byori.us manages DNS as a service.

byori.us is not responsible for outages or service disruptions caused by third-party platforms including but not limited to: Cloudflare, Acuity, Square, Vagaro, GlossGenius, or any booking platform.

7. AI Chat Disclosure

The AI widget is powered by Claude (Anthropic). Responses are AI-generated and may not always be accurate. Clients' customers should confirm details directly with the business. byori.us manages AI infrastructure as a service and is not liable for individual AI responses.

8. Intellectual Property

Upon receipt of final payment, you own the website content and design delivered to you. byori.us retains the right to display the work in portfolio materials unless you request otherwise in writing.

9. Limitation of Liability

byori.us liability is limited to the amount paid for the project. byori.us is not liable for lost revenue, business interruption, or any indirect or consequential damages.

10. Termination

If service is terminated due to non-payment or policy violation, subdomains are deactivated and site files may be requested within 30 days. Deposits are non-refundable regardless of termination reason. You may discontinue service with 30 days written notice; site files are transferred on best-effort basis at no charge for accounts in good standing.

11. Governing Law

These Terms are governed by the laws of the State of Arizona. Disputes are subject to binding arbitration in Maricopa County, Arizona.
